John Lewis Foreign Currency: a service provided by First Rate Exchange Services Limited

1. Provision of services

This online service for the provision of foreign currency and/or traveller’s cheques is provided by First Rate Exchange Services Limited for John Lewis customers (“this service”).

First Rate Exchange Services Limited is a company registered in England and Wales under company registration number 04287490 (Money Service Business licence number 12133160), whose registered office is at Great West House, Great West Road, Brentford, West London, TW8 9DF England (“we/us”).

You will access this service via a direct link from one or more website(s) (“the website(s)”) operated by John Lewis plc or its approved third parties. We may send you marketing information from John Lewis with your order.

These terms and conditions apply to this service.

This service is available to individuals aged 18 years or over, resident within the UK. Orders may only be placed by the registered cardholder of the card used to pay for the orders.

These terms and conditions are only available in English and we will only communicate with you in English.

2. Agreement

By using this service you confirm that you (1) are at least eighteen (18) years of age, (2) are the registered holder of the payment card, (3) have read and understood these terms and conditions and (4) agree to be bound by them and to comply with all applicable laws and regulations. You also agree to use this service to order foreign currency and traveller's cheques for holiday or business travel purposes only.

3. Important notice

The value of foreign currency can go up and down due to changes in exchange rates. These changes are outside of our control. In extreme situations, currency market conditions may prevent us from supplying currency to you. In such circumstances we reserve the right to cancel your order. If this happens, we will tell you.

If your order is cancelled due to currency market conditions we will refund the sterling amount that you have paid us to your card. We will refund any cash advance charges made by your card issuer on request.

4. Orders

You agree to provide the information required to process your order. We may apply a minimum and maximum order value limit for foreign currency and traveller's cheques and will tell you if this applies on the online ordering screen. We may also apply limits on the maximum amount you can order in a two week period. These limits may change from time to time. We only stock certain values of foreign bank notes and traveller’s cheques. This means we may need to round your order up or down on the online ordering screen to the nearest amount for which bank notes are available.

To place an order, follow the instructions on the online ordering screen. We may need to request further information from you at any time to enable us to complete your order and/or to comply with regulatory requirements. It is important that you provide correct contact details so that we may reach you should further information be required to process your order. If we are unable to contact you, this may result in your order not being processed and a full refund will be applied to your card. We will refund any cash advance charges made by your card issuer on request.

We can refuse to process your order for any reason; we will tell you if this is the case and a full refund will be applied to your card. We will refund any cash advance charges made by your card issuer on request.

A delivery charge may be applied to your order and, if applicable, will be detailed on the online ordering screen. We may amend this charge from time to time.

By placing the order, you confirm that the details contained in the order are correct in all respects. Once you have placed your order you will see a confirmation screen setting out the details of your order. This confirms we have received your order. Your order is completed when your credit or debit card payment has been accepted by us. Please print a copy of the confirmation screen for your records.

5. Foreign currencies and rates

This service is only available for the currencies listed on the online ordering screen. The exchange rates shown may be updated at any time. In extreme situations, currency market conditions may prevent us from supplying currency to you. In such circumstances we reserve the right to cancel your order as set out in Section 3 (Important notice). If this happens, we will tell you.

Please note that if you are arriving in the UK from a country outside the European Union (EU), or you are leaving the UK to travel directly to a country outside the EU you must declare cash amounts of 10,000 euros or more (or the equivalent amount in other currencies). This must be done by completing a Cash Declaration form (C9011). "Cash" includes banknotes, traveller’s cheques and prepaid money cards. To obtain a Cash Declaration form, please visit www.hmrc.gov.uk. It is your sole responsibility to meet the currency import and export measures and requirements of the UK and any country you may be visiting. Neither we, nor any John Lewis company, will be responsible for any losses, damages or claims you may suffer as a result of your failure to comply with these measures or requirements.

Foreign currency availability may be subject to monetary limits, currency exchange restrictions and anti–money laundering regulations.

6. Traveller's cheques

Traveller's cheques are supplied to us by American Express Europe Limited (“Amex”), acting on behalf of the relevant traveller's cheques issuers. All traveller's cheques will be subject to the relevant terms and conditions provided with your traveller's cheques issued by Amex from time to time and you should read those terms and conditions.

7. Anti-money laundering/fraud prevention/counter terrorism financing

We are supervised by Her Majesty's Revenue and Customs ("HMRC") as an HMRC registered Money Service Business ("MSB"). We take our obligations in respect of money laundering and terrorist financing very seriously and we are obliged to report to the appropriate authorities any suspicions and/or high value transactions without further reference. We may decline or cancel any orders, at any stage, which we believe, contravene our obligations under the appropriate Legislation /Regulation.

8. Delivery

Your order will be delivered to your chosen shop or to the billing address of the debit/credit card used to pay for the order.

If you choose delivery to your home, we will use the Royal Mail Special Delivery GuaranteedTM Service to deliver your order. Special Delivery GuaranteedTM requires a signature on receipt of your order. If, for any reason, you do not receive your order please contact us as detailed in the Contact us page, accessible through the online ordering screen. We will carry out a thorough investigation and may arrange a replacement order, alternative delivery or refund where appropriate. We may charge you for the replacement order while we investigate the reason for non-delivery or we may charge you for the replacement order when we complete the investigation depending on the outcome. We are no longer responsible once the order has been signed for at your delivery address and will not have any liability for fraudulent acts committed by any third party.

The delivery timings for orders are set out in the FAQs page, which is available on this website. We may change the delivery timings from time to time and, if such a change will affect your order, we will try to tell you as soon as is reasonably possible by telephone or email.

9. Payment

You must pay for your order in pounds sterling. The amount you have to pay is worked out by converting the total amount of foreign currency and/or traveller’s cheques into pounds sterling using the exchange rate that applies at the time you place your order.

You can pay for your order using most credit and debit cards issued in the UK (Maestro, MasterCard, Visa) provided the card is registered in your name and there are sufficient funds available to cover your order and fees. We will take payment on the day your order is placed or shortly after.

Your credit or debit card issuer may charge you interest and/or fees on paying by credit and/or debit card as they consider it a "cash advance". This is not a service charge made by us and we have no control over, and are not responsible for, these charges.

10. Order changes and cancellation by customer

(a) Foreign Currency

Because Foreign Currency is a money product, once an order has been submitted it cannot be changed. You may only cancel your order before we dispatch it. We, at our discretion, reserve the right to apply a cancellation charge up to the value of £20 per order.

If you cancel your order, you will still have to pay any cash advance charges made your card issuer and we will not refund these charges to you.

(b) Sterling traveller's cheques

You have a right to cancel your order for sterling traveller's cheques for a maximum period of fourteen calendar days beginning on the day after First Rate confirms your order as stated in Section 4 (Orders).

First Rate and American Express (“Amex”) cannot guarantee that the amount you will receive when you cash a sterling traveller's cheque will be equivalent to the original purchase price of such sterling traveller's cheque. The amount you receive when you cash in sterling traveller’s cheques will, where applicable, exclude: any commission and/or administration fees paid on your original order; any charges made by your card issuer; and any commission or administration fees charged in connection with cashing in the sterling traveller’s cheques.

If you cancel your order, you will still have to pay any cash advance charges made your card issuer and we will not refund these charges to you.

11. Personal information and security

For online security, we use secure server software. Details of how we may use your personal information are set out in the online Privacy policy and Security policy, links to both of which appear on the online ordering screen.

12. Limitation on our liability

We will make every effort to process orders placed via this service without any delay. However, delays can sometimes occur due to technical problems or matters out of our control.

We use reasonable care and skill in providing this service. However, we do not guarantee that access to this service will be continuous, uninterrupted, secure, error free or free from viruses.

We shall not be liable to you for the following:

  1. if we are unable to perform any of our obligations to you due to the failure of any technical systems or for any other reason, beyond our reasonable control including among other things: war, terrorism, government action, natural disaster or industrial dispute;
  2. for any damage to your computer equipment as a result of using the website(s) or this service; or
  3. for any claims or damages suffered by you or incurred by you as a result your use or delay or inability to use the website or this service.

If you do make a complaint or claim against us we will be liable to you for no more than the purchase price of your order.

Nothing in these terms and conditions limits our liability for death or personal injury caused by our negligence or that of our employees or our agents.

If any provision or part of these terms and conditions is found to be unlawful or unenforceable it will fall away and will not affect the validity or enforceability of the remaining terms and conditions or any of your statutory rights which cannot be excluded by these terms and conditions.

13. Disclaimer

None of the information provided in connection with this service is, nor should it be construed as, financial advice. Neither we, nor any entity we receive information from, are responsible for any investment or other decisions made on the basis of the information provided.

14. Third party rights

Nothing in these terms and conditions will confer any benefit on any third party or any right to enforce these terms and conditions.

15. Governing law

These terms and conditions are governed by and construed in accordance with English Law.

16. Fees and charges

Fees and charges which apply to your order will be displayed on the ordering screen during the online ordering process (except for any charges levied by your card issuer). We may change these fees and charges from time to time or add to them, but will show revised charges on the website before you place an order.

17. Variation of these terms and conditions

These terms and conditions are subject to change from time to time without notice and First Rate reserves the right to make these changes at any time without notice. You are required to read these terms and conditions before placing an order. Your continued use of this service after these changes constitutes your acceptance of these terms and conditions as modified.
